Terms and Conditions

1. Quotations are purely an Estimate and may change once on site in case of electrical conditions unknown or withheld to Marnies. On-site conditions will be confirmed and any additions to an Estimate will be communicated to the client before installation.
2. The client must make known the name of the contact person as the single point of contact for both the installation as well as the payment of accounts.
3. This Estimate is valid for a period of 7 days only due to currency fluctuations in the exchange rate and availability of stock items due to excessive demand. Marnies are price takers and all equipment is sourced through reputable suppliers with the appropriate warranties.
4. Should the estimate be accepted after 7 days, prices quoted might have to be recalculated and stock availability renegotiated.
5. Delivery is normally ex stock unless the supplier advises to the contrary, which will be communicated to the customer. Once the deposit is paid, the equipment will be secured immediately.
6. Ownership of the equipment remains the property of Marnies until the account is paid in full. Should Marnies be liquidated once the Estimate has been accepted and deposits paid, the customer has the right to take over the equipment against the deposit already paid.
7. Marnies is a cash concern and do not carry accounts unless terms are pre-arranged.
8. Deposits:
A minimum of 80% or in some cases, 100%, to cover the cost of the equipment is to be paid immediately on acceptance of the quotation. The balance of 20% is required on completion of the job as soon as the customer has completed his inspection but at least within 12 hours of installation. The snag list, if any, should be communicated to Marnies within 24 hours. The customer will not be charged extra for bad or incomplete workmanship.
9. Interest on overdue amounts at 2% above ruling bank overdraft rate will be in force.
10. In the event of the customer failing to make payment of any amount due by it on due date and should Marnies instruct its attorney to recover money or goods from the customer, the customer shall be liable for and pay all legal costs incurred by Marnies.
11. Warranty on Product: as per individual manufacturer’s warranty clause, be it 6, 12, 24 or 36 months, respectively, the supplier will be liable to replace in the event of a defect. NB: there is a very limited warranty on any electronic equipment. The Consumer Protection Act (CPA) remains in effect.
12. The Supplier does not cover Marnies’ labour charge for ‘warranty’ claims in case of defective equipment supplied and replaced where it needs reinstallation by Marnies. This labour charge will be recouped from the customer.
13. Warranty on Workmanship (The CPA remains in effect):
a. three months from date of installation except due to Act of God (events outside human control, such as sudden natural disasters, for which no one can be held responsible).
b. Electrical surges due to power outages are not covered as well as lightning or malicious damage. Clients must ensure that they are adequately covered by their insurance company with specific cover for surges.

c. Any issues directly linked to the installation of the said equipment that may occur are guaranteed for a three month period and all callouts relating to the installation will be for the account of Marnies. Thereafter, Marnies is entitled to charge a normal callout fee.
Should it be equipment defect/failure, Marnies will ensure that the product is replaced at the supplier’s cost and Marnies will charge their callout fee that prevails at the time of the replacement.
d. Any changes or movement outside of the guidelines will be charged for. This contract is only with respect to the installation as per said quotation, any additional work requested falls outside of this contract and will be invoiced and charged for separately.
e. Marnies will not be held liable for damage to property as a result of bad workmanship on any installations by a third party ie electrical problems, inadequate or bad paint jobs; paint deterioration, plastering, welding, cabling deterioration, etc.
f. Marnies will not accept responsibility to paint gates, walls, etc. except where the installation has taken place and has to be touched up to the customer’s satisfaction. Where Marnies has completed any welding, the technician will only apply primer as it is the customer’s responsibiity to match the original paint.
g. Any complaints due to faulty material or workmanship, must be relayed to Marnies’ office by telephone (011 472 5413) within 24 hours of installation and confirmed in writing via email to office@marnies.co.za.
14. It is the customer’s responsibility to carry adequate insurance.
15. Marnies carries its own insurance in the event of any accidents that may occur on a client’s property where Marnies is deemed responsible.
16. Technical staff have been with Marnies for close on 20 years and no casual labour will be used unless expressly requested by the client for which Marnies will find reputable vetted persons to assist.
17. This Estimate shall be interpreted according to the laws of the Republic of South Africa. 

COVID-19

Marnies and their staff adhere to all safety measures and regulations put in place due to the pandemic.
Should a typing error inadvertently have appeared on this Estimate, Marnies must communicate any rectification needed to the customer, with immediate effect.
